General Conditions of Sale Tre Pi Profumerie
1. Introduction
1.1 The offer and sale on our website www.trepiprofumerie.com (hereinafter "Site"), owned by Tre Pi Profumerie Srl (hereinafter "Company"), are governed by these General Conditions of Sale (hereinafter "General Conditions") pursuant to articles 50 and following of Legislative Decree no. 206 of 6 September 2005 (Consumer Code).
1.2 These General Conditions govern all phases of purchasing the products offered on the Site, from selection to order, up to delivery. By making a purchase on the Site, the Customer fully accepts these General Conditions.
1.3 For all matters not expressly regulated in these General Conditions, the current Italian legislation applies, with particular reference to the Consumer Code and Legislative Decree no. 70 of 9 April 2003 regarding electronic commerce.
1.4 Any exceptions to these General Conditions will be valid only if agreed in writing with the Company.
2. Product Guarantees and Prices
2.1 The Site sells exclusively MADE IN EUROPE products, distinguished by their respective trademarks.
2.2 Used, irregular or lower quality products than the standards offered on the market are not for sale.
2.3 The essential characteristics of the products are described in the product sheets on the Site. The images and colours may differ from the actual ones due to the settings of the monitor or browser used.
2.4 In the event of exercising the right of withdrawal, the Company reserves the right not to accept the return or not to fully refund products that have been altered in their essential characteristics or quality, or that are damaged.
2.5 The sales prices are indicated in euros and include VAT and other taxes, excluding shipping costs. Shipping costs are specified in the Shipping section and vary according to the delivery method, payment, destination and total amount of the order.
2.6 Any obvious errors in the prices or descriptions of the products do not bind the Company, which will communicate any corrections to the Customer before processing the order.
3. Product Availability
3.1 Orders are accepted within the limits of the quantities available in stock. In the event of unavailability of a product, the Customer will be promptly informed by email or telephone.
3.2 In case of partial cancellation of the order, only the amount relating to the available products will be charged. Any sums already paid for unavailable products will be refunded.
3.3 In case of total cancellation of the order, no charge will be made.
3.4 The Company reserves the right to refuse an order if there are doubts about the veracity of the information provided by the Customer.
4. Purchase Procedure
4.1 Products can be selected and added to the cart by clicking on the Buy icon .
4.2 In the cart the Customer can check and modify the selected products, including the desired quantity.
4.3 It is mandatory to correctly fill in all the required fields in the order form.
4.4 The Company declines all responsibility for errors in completing order forms or for delivery problems caused by incorrect information provided by the Customer.
4.5 Before sending the order, the Customer will see a detailed summary, including shipping costs. The order is confirmed by clicking on the confirmation button.
4.6 After sending the order, the Company will send a confirmation email and subsequently a shipping notification.
4.7 By sending the order, the Customer accepts these General Conditions, the Conditions of Use of the Site and the legislation on privacy.
4.8 Any modification or cancellation of the order by the Customer must be requested promptly and can only be accepted if the order has not yet been shipped.
5. Payment Methods
5.1 The Site offers the following payment methods: Credit Card, PostePay, PayPal, bank transfer and cash on delivery. The methods are better described in the Payment Methods section .
5.2 Financial data (e.g. credit card number) are treated securely and not accessible to third parties.
5.3 Payment can only be made in Euros. Any additional costs for international transactions are the responsibility of the Customer.
5.4 For orders with cash on delivery there is an additional cost of €4.90. This method is not available for customized products.
5.5 The Customer guarantees that he/she has the rights to use the chosen payment method. Any fraudulent use of the payment method will be prosecuted.
6. Billing
6.1 The invoice will be issued based on the data provided at the time of ordering. After issuing it will not be possible to modify it.
6.2 The request for an invoice for purchases made as an end consumer must be made before the order is concluded.
7. Promotional Codes
7.1 Promotional codes must be entered in the appropriate field during checkout.
7.2 Promotional codes cannot be combined with other promotions.
7.3 Vouchers can be percentage or fixed amount and are valid only for online purchases.
7.4 Promotional codes cannot be converted into cash or used on orders already placed.
8. Delivery of Products
8.1 The delivery methods, times and costs are detailed in the Shipping section . These indications form an integral part of these General Conditions.
8.2 The Company is not responsible for delays caused by force majeure, such as strikes, health emergencies or adverse weather conditions.
8.3 In the event that the package is not delivered due to the Customer's absence, any redelivery costs will be borne by the Customer.
9. Right of Withdrawal
9.1 The Customer has the right to withdraw from the contract within 14 days of delivery, without penalty and without the need for motivation, pursuant to art. 52 of the Consumer Code.
9.2 Withdrawal is not permitted for personalized or sealed products that cannot be returned for hygiene reasons.
9.3 Return costs are borne by the Customer, except for defective or non-compliant products.
9.4 The Customer must ensure that the returned products are intact, in the original packaging and unused.
10. Refund Times and Methods
10.1 Refunds will be made within 14 days of receipt and verification of the returned products.
10.2 The refund will be made using the same payment method chosen by the Customer or via a discount voucher.
10.3 Any delays in refunds attributable to incorrect bank details provided by the Customer will not be the responsibility of the Company.
11. Additional Clauses
11.1 Customer Identity Obligation : The Customer guarantees that he/she is the owner of the payment method used.
11.2 Data Processing : Customer data will be processed in compliance with the GDPR regulations.
11.3 Exclusion of Liability : The Company is not responsible for delays or impossibility of delivery due to force majeure.
11.4 Customer Responsibility : Any damage caused by the Customer during improper use of the purchased products is exclusively his responsibility.
12. Competent Court
12.1 For disputes relating to the General Conditions, the court of the consumer's residence shall have jurisdiction, or, alternatively, the Court of Caserta.
13. Changes and Updates
13.1 The Company reserves the right to modify or update these General Conditions at any time without notice.
13.2 The changes apply only to orders placed after the date of publication on the Site. We invite Customers to check the General Conditions before each purchase.
13.3 Any updates will be communicated to the Customer via email, where necessary.
14. Intellectual Property
14.1 All contents on the Site, including texts, images, logos and trademarks, are the exclusive property of the Company or their respective owners.
14.2 Reproduction, distribution or use of such content without the written consent of the Company is prohibited and will be prosecuted under applicable laws.
14.3 Access to the Site does not grant any rights to the contents, except as expressly authorised.
15. Free Shipping
15.1 Orders with a value equal to or greater than €79.90 benefit from free shipping, applied automatically at checkout.
15.2 Free shipping applies only to destinations covered by the standard service and is not valid for any express or international delivery options.
15.3 If an order qualified for free shipping is partially returned, the Company reserves the right to charge shipping costs for the items retained.
16. Free Samples
16.1 For each order placed, the Company offers free samples of the products currently available, subject to stock availability.
16.2 Samples are selected by the Company and cannot be replaced or specifically requested by the Customer.
16.3 Free samples are not subject to a replacement guarantee.
17. Easy Returns
17.1 In case of dissatisfaction with a purchased product, the Customer can request a return within 14 days, following the instructions in the Returns section on the Site.
17.2 Returned products must be intact, in the original packaging and free from signs of use. Any damage or missing items may result in a reduction of the refund.
17.3 The Company reserves the right to refuse returns that do not comply with the conditions indicated above.
18. Reviews on the Site
18.1 Customers can leave reviews on purchased products using the appropriate form on the product sheet.
18.2 Reviews must be relevant, respectful and compliant with current legislation. Offensive, defamatory or advertising content will be removed.
18.3 The Company reserves the right to moderate or remove reviews that do not comply with these criteria.
18.4 The insertion of a review grants the Company the right to use it for promotional purposes, without obligation to compensate.
19. Online Dispute Resolution (ODR)
19.1 In compliance with European legislation, Customers residing in the EU can use the ODR platform for the extrajudicial resolution of disputes relating to online purchases.
19.2 The platform is available at the following link: https://ec.europa.eu/consumers/odr .
19.3 The Company undertakes to collaborate for a rapid and fair resolution of disputes through the ODR platform.
